The User/Commissioner agrees that:
* The Illustrator’s Work, Artwork, sketches, drafts, concept development materials, and any part of the creative process ("Development Materials") may not be used, copied, imitated, adapted, or otherwise utilised by any employee, contractor, freelancer, or third party for the purposes of learning, training, style replication, or further development without the Illustrator’s prior written consent;
* Development Materials may not be incorporated into, modified, or assigned to another illustrator, artist, or creative for completion, adaptation, or derivative work without the Illustrator’s prior written consent;
* No part of the Illustrator’s Work or Development Materials shall be used to create internal training resources, style guides, AI training material, or any other tools intended to replicate or simulate the Illustrator’s distinctive style, process, or creative method.
Any breach of this clause shall be treated as a material breach of the Agreement, and the Illustrator shall be entitled to seek injunctive relief, damages, and/or termination of the licence.
The User/Commissioner shall not, without the Illustrator’s prior written consent:
* Use or otherwise make available the Work or any Artwork (including preparatory designs) for the purpose of training, fine-tuning, or developing any artificial intelligence (AI), machine learning (ML), generative AI systems, neural networks, or similar technologies;
* Use the Work or Artwork as input for any generative AI tools or services (including, but not limited to, image generation, data training, or algorithmic learning purposes);
* Authorise or permit any third party to use the Work or Artwork for such purposes.
The rights granted to the Commissioner under this Agreement are strictly limited to the specific uses outlined and do not include any rights related to AI, ML, or similar technologies.
Any breach of this clause shall constitute a material breach of this Agreement, entitling the Illustrator to seek injunctive relief, damages, and/or termination of the licence immediately.
